Many people must deal with the consequences of doctor mistakes, medical malpractice, misdiagnosis, and other errors that often result in serious injury, disability, or death.

Physicians, Nurses, Hospitals, and other health care providers can be held liable for negligence where they failed to use the care and skill which reasonably competent practitioners in their locality would exercise in similar circumstances.

Further, doctors can be held liable when they fail to explain the risk of medical treatment, so that a patient can weigh the risks and benefits of that treatment, and make a decision based on an “informed consent” to treatment.  A doctor must discuss with a patient the nature of the problem, the proposed treatment & alternatives, the probability of success of the proposed treatment & alternatives, and the serious risks and potential side effects of the proposed treatment.
